In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), TheFlixer will respond promptly to claims of copyright infringement committed using our website that are reported to our Designated Copyright Agent.

If you are a copyright owner, or authorized on behalf of one, and you believe that your work has been copied in a way that constitutes copyright infringement, please submit your complaint to our Designated Copyright Agent, providing the following information:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
  2. A description of the copyrighted work that you claim has been infringed;
  3. A description of where the material that you claim is infringing is located on the website;
  4. Your address, telephone number, and email address;
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Upon receipt of a compliant notice, TheFlixer will take the following actions:

  1. Remove or disable access to the allegedly infringing material;
  2. Notify the user who posted the allegedly infringing material that it has been removed or disabled;
  3. For repeat offenders, terminate the user’s access to the website.

If you believe that your material has been removed by mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent. The counter-notification must include:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, and that you will accept service of process from the person who provided notification of the alleged infringement.

Upon receipt of a compliant counter-notification, TheFlixer will promptly provide the person who provided the original notification with a copy of the counter-notification, and inform that person that TheFlixer will replace the removed material or cease disabling access to it in 10 business days. TheFlixer will then replace the removed material and cease disabling access to it not less than 10, nor more than 14, business days following receipt of the counter-notice, unless our Designated Copyright Agent first receives notice from the person who submitted the original notification that such person has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on our system or network.
